Medical Malpractice Insurance Evaluation
The Medical Malpractice insurance market has recently undergone significant changes, and the market is now seeing widespread improvements. Every physician should be aware of how these changes impact their coverage and bottom line.

To help all members capitalize on these positive changes, McLachlan Kane Insurance Agency, Inc., the largest New Jersey based insurance agency specializing in medical malpractice insurance, will provide each member with a free evaluation of his or her current malpractice coverage. Because McLachlan Kane represents all of the leading insurance carriers in New Jersey, McLachlan Kane can provide options that might not otherwise be available.

Managed Care Strategies
Managed care companies’ concern with managing their bottom lines can interfere with physicians’ sound medical judgments. THIS IS UNACCEPTABLE. Policies that result in denial of physicians’ recommendations for care, diagnosis or treatment compromise patient health, cause serious injury and even death. As a top priority, NJ PHYSICIANS is committed to ending this abuse. NJ PHYSICIANS believes that public exposure of documented cases of patient injury resulting from interference with sound medical care will lead to an end to bureaucratic interference with good medical care. To document, compile and verify these abuses, NJ PHYSICIANS has created “THE REGISTRY.”

Malpractice Insurance Premium Relief
Risk Prevention Programs will be offered in cooperation with the State’s major malpractice insurers. Successful completion of these programs could result in substantial reductions in Medical Liability Insurance Costs. We have already received a commitment from a major insurance company to provide a comprehensive toolkit provided to all members of NJ PHYSICIANS at no cost, as well as commitments from other companies to provide risk prevention programs and other assistance to all members of NJ PHYSICIANS without charge. The kit includes valuable tips for reducing risk, including sample consent forms and letters on how to deal with noncompliant patients.

Risk Purchasing Groups
New Jersey law allows the formation of risk purchasing groups to negotiate reduced premiums for malpractice insurance. NJ PHYSICIANS is developing strategies to create these groups for the benefit of its members.

Health Plans
QualCare is committed exclusively to the New Jersey marketplace and believes that medical care should be delivered as a local service. It offers one of the most expansive provider networks in New Jersey with 88 acute care hospitals and more than 19,000 physicians at more than 31, 000 locations. Physicians, not lay people, make all the medical decisions for QualCare's clients. NJ PHYSICIANS will work to promote the QualCare model throughout New Jersey.

Regulatory Defense Coverage
More and more physicians are required to answer to the New Jersey Board of Medical Examiners, based upon patient complaints, complaints from third party payors, and others. As part of your membership dues, through the Physician Advocacy Program™, experienced legal counsel will assist you in responding to complaints to the Board of Medical Examiners and even appear with you at an investigative inquiry, should the Board require your appearance. The program is provided by Kern Augustine Conroy & Schoppmann, P.C. and is currently offered to physicians at the cost of $175/year. As a member of NJ PHYSICIANS, you will receive this benefit at no charge.

Litigation Support
If you are wrongly named in a malpractice suit and are dismissed within 180 days, by law your insurance premium cannot increase because you were sued. Unfortunately, few physicians get dismissed during this period, often because insurance companies and their retained counsel do not aggressively pursue dismissal.

As a member of NJ PHYSICIANS any medical malpractice suit brought against you will be immediately evaluated. If there is a reasonable chance of you being dismissed within this 180-day period, NJ PHYSICIANS will work with your insurance company appointed attorney to achieve that result. This benefit is included in your annual dues, at no additional charge to you.

Legal Representation
Legal services and resources will be provided by the Law Firm of Kern Augustine Conroy & Schoppmann, P.C., New Jersey’s largest healthcare law firm representing only the interests of physicians in healthcare. Kern Augustine has a proven track record. The firm has been successful in convincing the New Jersey Supreme Court to reverse an Appellate Court decision which would have subjected physicians to treble damages and attorneys fees under the Consumer Fraud Act; in having the Federal Courts apply the provisions of the Americans With Disabilities Act to protect physician confidentiality; in limiting the right of the state to search physicians’ offices and many other landmark decisions. The firm regularly represents physicians before federal and state regulatory agencies.
